SBE Wins $28.2 Million Jury Verdict Against Kaiser Permanente
Michael J. Bidart and Danica Dougherty of Shernoff Bidart Echeverria LLP were successful in convincing a Los Angeles Superior Court jury that client Anna Rahm lost her leg as a result of Kaiser Permanente’s poor treatment.
The jury unanimously concluded that Kaiser Permanente breached the standard of care and awarded damages of $28.2 million. Additionally, 10 of the 12 jurors found in favor of Anna on causation.
Kaiser Permanente argued that in the unlikely event that the jury got past causation, they should apportion fault to a non-Kaiser, board-certified radiologist who misread an x-ray film taken of Anna one week before she went to Kaiser for her back pain. Ten of the jurors disagreed and found Kaiser Permanente 100% liable for this horrific tragedy.
